User Agreement

This Agreement outlines your responsibilities and the protections that apply when using Dourr. It supplements our Terms of Service and should be read together with them.

Effective date:

1. Agreement Overview

This User Agreement ("Agreement") sets out the terms and conditions under which you ("User", "you", or "your") may access and use the Dourr platform ("Platform", "we", "us", or "our"). By creating an account or continuing to use the Platform, you confirm that you have read, understood, and agree to be bound by this Agreement, which supplements our Terms of Service.

2. Platform Role and Limitations

  • Dourr is a technology marketplace that connects property listers with prospective renters. Dourr is not a real estate agent, property manager, landlord, or tenant. We do not own, operate, or control any listed property.
  • Any rental agreement, tenancy arrangement, or financial transaction arising from a connection made on the Platform is entered into solely and directly between the Lister and the Renter. Dourr is not a party to any such agreement.
  • Payments, deposits, or any arrangements made outside this platform are not supported, facilitated, or covered by our policies. Dourr bears no responsibility or liability for any loss, dispute, or damage arising from transactions conducted outside the Platform.

3. User Responsibilities

  • You must provide accurate, truthful, and up-to-date information in your account profile and all communications on the Platform.
  • You are solely responsible for evaluating the accuracy, completeness, and suitability of any listing, lister, renter, or property before entering into any arrangement.
  • You must conduct all communications and negotiations through Dourr's in-app messaging system. This creates a verifiable record that protects all parties and enables our support team to assist in disputes.
  • You must never share personal financial information, including bank account numbers, passwords, or payment credentials, through any messaging channel.
  • You must physically view any property in person before making any deposit, payment, or entering into any tenancy agreement.

4. Off-Platform Interactions

  • The Platform assumes no responsibility for any interactions, communications, agreements, or transactions made outside of Dourr. Users who choose to engage outside the Platform do so entirely at their own risk.
  • Dourr's safety protections, including contact detection, message monitoring, dispute visibility, and reporting systems, only function within the Platform. Moving interactions to WhatsApp, Telegram, email, or any external channel means you lose all Platform protections.
  • Dourr strongly advises against engaging in any rental-related discussions, negotiations, or payments outside the Platform. If a user insists on moving communication off-platform, consider this a potential red flag and report it immediately.

5. Prohibited Actions

  • Requesting or collecting deposits, holding fees, or any form of payment from a prospective renter before a physical viewing of the property.
  • Sharing or soliciting personal contact information (phone numbers, email addresses, social media handles) to circumvent Platform protections.
  • Submitting false, misleading, or fraudulent information in listings, profiles, or communications.
  • Impersonating another person, entity, or property owner without lawful authority.
  • Using the Platform for any purpose that violates applicable Malaysian law, including the Personal Data Protection Act 2010, the Contracts Act 1950, or the Communications and Multimedia Act 1998.

6. Deposits and Payments

  • Requesting, soliciting, or collecting any form of deposit, holding fee, or payment from a prospective renter before the renter has physically viewed the property in person is strictly prohibited on Dourr.
  • Any deposit or payment should only be made after physically viewing the property, verifying the lister's identity and authority, and executing a proper tenancy agreement.
  • Dourr does not process, hold, or facilitate any financial transactions between users. All payments are arranged directly between the Lister and the Renter. Dourr shall not be held liable for any financial loss arising from payments made between users, whether on or off the Platform.

7. Dispute Resolution Between Users

  • In the event of a dispute between users, Dourr may, at its sole discretion, review communications conducted through the Platform and provide relevant records to assist in resolution. Dourr is not an arbitrator or mediator and has no obligation to resolve disputes between users.
  • Users are encouraged to seek independent legal advice for any dispute arising from a rental arrangement facilitated through the Platform.

8. Limitation of Liability

To the fullest extent permitted by Malaysian law, Dourr shall not be liable for any direct, indirect, incidental, consequential, or punitive damages arising from: (a) your use of or inability to use the Platform; (b) any interaction, transaction, or arrangement between users; (c) any off-platform communication or transaction; (d) any property listed on the Platform, including its condition, legality, or suitability; or (e) any reliance on information provided by other users. Your sole remedy for dissatisfaction with the Platform is to cease using it.

9. Indemnification

You agree to indemnify, defend, and hold harmless Dourr and its directors, officers, employees, agents, and affiliates from and against any claims, losses, liabilities, damages, costs, and expenses (including reasonable legal fees) arising from: (a) your breach of this Agreement; (b) any off-platform interaction, transaction, or arrangement you enter into with another user; (c) any dispute between you and another user arising from a rental arrangement; or (d) your failure to conduct due diligence before entering into any rental arrangement.

10. Governing Law

This Agreement shall be governed by and construed in accordance with the laws of Malaysia. Any dispute arising from this Agreement shall be subject to the exclusive jurisdiction of the courts of Malaysia. This Agreement is subject to the governing law and dispute resolution provisions of the Terms of Service.

11. Amendments

Dourr reserves the right to update this Agreement at any time. Material changes will be communicated via email or a prominent notice on the Platform at least fourteen (14) days prior to taking effect. Your continued use of the Platform after such notice constitutes acceptance of the revised Agreement.

This User Agreement supplements the Dourr Terms of Service. Dourr is a technology platform and is not a party to any tenancy agreement between users. All transactions are solely between the Lister and the Renter. Nothing in this Agreement constitutes legal advice.
